We are often asked what happens if an employee doesn’t make their unfair dismissal application within the 21 day timeframe. Can they still make an application if it is late?

Two recent decisions from the Fair Work Commission (FWC) have highlighted the importance of employees acting prudently to ensure their applications are lodged within the timeframe. Two other cases have shown what ‘exceptional circumstances’ may be for an employee to make their application out of time.
